Council Decision On The Conclusion Of The Withdrawal Agreement

The European Commission has published, on behalf of the European Atomic Energy Community, the full text of the 1256-year Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the European Atomic Energy Community on Cooperation in the Safe and Peaceful Uses of Nuclear Energy and the Conclusion by the European Commission. the Trade and Cooperation Agreement between the European Union and the European Atomic Energy Community, of the one part, and the United Kingdom of Great Britain and Northern Ireland, of the other part, which is Annex 1 to the Recommendation for a Council Decision authorising the conclusion of the Agreement by the European Commission. Withdrawal Agreement and Council Decision on its conclusion The Agreement is now signed by both parties on 30 December 2020. European Council President Charles Michel and European Commission President Ursula von der Leyen will sign in Brussels on behalf of the European Union, while Prime Minister Boris Johnson will sign in London on behalf of the United Kingdom. Today, five non-legislative acts on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community were published in the Official Journal. The Council today adopted, by written procedure, the decision on the signing of the EU-UK Trade and Cooperation Agreement and its provisional application from 1 January 2021, pending the consent of the European Parliament and its conclusion by the Council decision next year. Prior to withdrawal, a withdrawal agreement was negotiated to ensure that the main political and economic ties between the EU and the UK are not severed overnight with the withdrawal. This agreement has been in force since 1 February 2020, when the UK left the EU. It provides for a transitional period until 31 December 2020, during which EU legislation will continue to apply to the UK and the UK will remain a member of the EU internal market and the EU customs union.

During this transitional period, the EU and the UK are negotiating their future relationship. The political declaration of the two parties on the future relationship accompanies the Withdrawal Agreement and sets the framework for the negotiations. The Commission will swiftly propose to the Council decisions on the signing and provisional application and conclusion of the Agreement. 6.The Council shall adopt the decisions referred to in paragraphs 1 and 5 by means of implementing acts on a proposal from the Commission. The agreement addresses, in separate protocols, the very specific situation of Ireland/Northern Ireland, the sovereignty areas of the United Kingdom in Cyprus and Gibraltar. Since Ireland, the Republic of Cyprus and the Kingdom of Spain may be required to conclude bilateral agreements with the United Kingdom necessary for the proper functioning of the agreements provided for in those specific protocols, it is appropriate to define the conditions and procedure for empowering each Member State to negotiate and conclude such bilateral agreements where those areas fall within the exclusive competence of the European Union. In view of the political importance of decisions on the granting of such authorisations, the power to adopt such authorisations should be delegated to the Council by means of implementing acts on a proposal from the Commission. On 29 March 2017, the United Kingdom notified the European Council of its decision to leave the European Union. The Withdrawal Agreement settles all issues of unravelling and clearly sets out the conditions for the transition and its duration. The Withdrawal Agreement is therefore appropriate and proportionate to the objective of ensuring an orderly exit of the United Kingdom from the Union. Following the formal signature, the signing and provisional application decision adopted today, as well as the agreement itself, will be published in all languages in the Official Journal of the EU and will be applied provisionally from 1 January 2021.
